SOUTHFIELD, Mich. – Brooks Kushman Shareholder Tom Cunningham and Associate Dustin Zak are presenting at the upcoming Institute of Continuing Legal Education (ICLE) Intellectual Property (IP) Law Spring Seminar on March 25, 2021. The seminar is designed to tackle critical updates and insights on the topics of patent and trademark law.
Cunningham and Zak’s presentation, titled “Navigating IP Protection and Enforcement in the District of Amazon,” discusses how infringements of IP rights are dealt with on e-commerce platforms. The presentation explores Amazon’s Brand Registry, trademark infringement complaint process, and Utility Patent Neutral Evaluation Procedure. It also discusses how these accelerated proceedings are well-suited for e-commerce and how the reduced cost makes enforcing IP more practical to a broader market.
Tom Cunningham has over 20 years of experience in intellectual property law and his cases have involved a wide range of technologies from automotive and locomotive developments to flashlights, biotechnology, numerous consumer products, dietary supplements and computer software. He has practiced all aspects of IP law and has litigated cases on behalf of both plaintiffs and defendants in federal courts all over the country. Tom also has an active practice advising clients on the management and licensing of IP. He has also worked closely with clients to help them avoid the intellectual property of others, including actively participating in designing around patents.
Dustin Zak is a registered patent attorney who focuses his practice on the prosecution of patent applications and patent litigation. He is also a member of the Online Enforcement and Anti-counterfeiting practice group at Brooks Kushman, which implements unique strategies to protecting client’s intellectually property in the growing digital marketplace. As a member of the Online Enforcement and Anti-counterfeiting practice group, Dustin frequently participates in Amazon’s Patent Neutral Evaluation program.Prior to joining Brooks Kushman, Dustin spent 5 years gaining technical experience as a Research and Development Chemist at an automotive OEM supplier and in the automotive after-market refinish industry. In these roles he formulated, developed, and launched various products globally, making him well equipped for matters involving the chemical and materials arts. Prior to working as a Chemist, Dustin obtained a degree in Polymers and Coatings Technology.
