Head of Trademarks at Brooks Kushman Weighs in on Slogan “Imported from Detroit”

March 21, 2011 – Brooks Kushman shareholder and head of trademarks, Mark Sparschu was quoted in the recent Crain`s Detroit Business article where Chrysler Group LLC is suing Moda Group LLC for trademark infringement, unfair competition, deceptive trade practices, unjust enrichment and other claims for using the phrase “Imported from Detroit.”

“If Chrysler were encountering this controversy (with a company) in Germany, then you might have to worry about a descriptiveness defense, as to the imported aspect of the phrase,” said Sparschu.  “But here, in fact, the phrase is not descriptive – it`s a uniquely expressed idea by Chrysler.”
