Shake Shack Seeks Patent on use of Metro Detroit Chicken Shack’s Name

SOUTHFIELD, Mich. – Brooks Kushman President Mark Cantor was featured in Crain’s Detroit Business’ June 6, 2015 article, “Shake Shack seeks patent on use of metro Detroit Chicken Shack’s name.”

In the article, Cantor discusses a trademark recently filed by Shake Shack with the U.S. Patent and Trademark Office for the restaurants’ Chicken Shack sandwich. Metro Detroit-based Sobeck Enterprises, Inc. owns a similar trademark for its chain of Chicken Shack restaurants.

According to Cantor, “The key differences in the trademark claims boil down to this: Chicken Shack holds a trademark on specific stylized renditions of its name, sign fonts and logo design. Shake Shack, meanwhile, is seeking protection of the phrase “Chicken Shack” itself — a longshot.”
