Southfield, Mich.Brooks Kushman Shareholder John LeRoy will be a panelist at the upcoming Patent Masters™ Litigation 2021 event hosted by IPWatchdog.

Over the past year, there have been several eye-popping patent infringement verdicts. In March 2021, Intel was ordered by a West Texas jury to pay $2.2 billion for infringement. In October 2020, Cisco Systems was ordered to pay $1.9 billion in a non-jury trial in Norfolk, Virginia, including a 2.5x multiple for “willful and egregious” conduct. Are these and other large patent verdicts aberrations, or will they become the new normal and indicative of modern economics? While the Federal Circuit seems comfortable with damages in the tens of millions or even in a few hundred million, historically CAFC has found reasons to overturn or reduce these large verdicts. Will the Federal Circuit allow such large verdicts to stand appeal? In this panel titled, “Billion Dollar Patent Verdicts: How, Why and Will the Federal Circuit Let Them Stand,” panelists will discuss their thoughts on this topic and provide insight on what practitioners can expect moving forward.

This inaugural Patent Masters™ Litigation program will focus on patent litigation in the United States. During the sessions, speakers will explore litigation in the most active federal district courts in the country, at the International Trade Commission (ITC) and appeals to the United States Court of Appeals for the Federal Circuit. They will also take a look at special issues of importance, including damages, patent eligibility, Standard Essential Patents, and litigation funding. If it happens as a part of litigating patents in the U.S., it will be covered it as a part of this program.

LeRoy has been representing the automotive industry in patent litigation matters concerning electronics and computer software for nearly 20 years. He has extensive experience dealing with wireless technology and Standard Essential Patents. He is Co-Chair of Brooks Kushman’s patent litigation department and the Chair of the firm’s standard essential patent and open source software practices. He holds a Master’s Degree in Electrical Engineering, is a licensed patent attorney, and litigates patent disputes in federal courts nationwide.
