BK Obtains Federal Circuit Affirmance of Order Dismissing Action in ND Texas

On June 6, 2017, the Federal Circuit affirmed a decision by the U.S. District Court for the Northern District of Texas dismissing a declaratory judgment action filed against Brooks Kushman’s client Ford Global Technologies LLC by New World International, Inc. Ford had accused New World of infringing patents covering parts of the F-150 pickup truck, and New World filed a declaratory judgment action alleging the Ford’s cease and desist letters were a basis for jurisdiction over Ford in the Northern District of Texas. The district court granted Ford’s motion to dismiss the action, and the Federal Circuit affirmed. In a decision by Chief Judge Sharon Prost, the Federal Circuit held that a license Ford granted to a separate company operating in the district was insufficient to establish jurisdiction in the Northern District of Texas.
