On April 21, 2016, the U.S. District Court for the Eastern District of Pennsylvania granted a motion for summary judgment filed by Brooks Kushman on behalf of its client, Ford Motor Company, in a case involving a patent for fuel injection system technology. TMC Fuel Injection System, Inc. originally filed suit against Ford in 2012. Brooks Kushman responded to the lawsuit by filing a petition for inter partes review of the TMC patent with the USPTO Patent Trial and Appeal Board. In the IPR, the PTAB concluded that during prosecution the applicant disclaimed specific fuel injection system elements. Based on that determination, Brooks Kushman filed a motion for summary judgment and on April 21, 2016, U.S. District Judge Norma L. Shapiro granted the motion ending all claims against Ford on the grounds that the TMC patent did not cover the accused Ford vehicles.
