Brooks Kushman Attorneys to Speak at Michigan Intellectual Property Law Association Luncheon

SOUTHFIELD, Mich. – Brooks Kushman shareholder Chris Smith and Of Counsel David Berry will be speaking at the Michigan Intellectual Property Law Association February lunch meeting. Their presentation is titled “All Bark, No Bite: An Analysis of IP Contractual Terms that are Unenforceable or Result in Unintended Consequences.” The attorneys will discuss common IP-related contracts that are negotiated and performed at the intersection of multiple bodies of law and, as a result, provisions in licenses and other contracts involving intellectual property rights sometimes prove to be unenforceable or are interpreted in ways that the parties did not expect.

Smith concentrates his practice on intellectual property litigation, with a primary emphasis on patent litigation. In addition to litigation, Smith is involved with the preparation of invalidity and infringement opinions as well as licensing disputes. He has represented clients from Fortune 500 companies to start-ups and individual inventors in a variety of industries. Smith is experienced in a wide range of technologies, including automotive and infotainment, medical devices, internet and content delivery networks, and telecommunications and fiber optics.

Smith earned a Bachelor of Science in Engineering in Materials Science and Engineering from the University of Michigan, and his J.D. from UCLA.

Berry is a registered patent attorney and has more than 15 years of law practice experience focusing on patent litigation and IP licensing. He has represented clients in all phases of litigation, including pre-trial proceedings, bench and jury trials and appeals, including arguing before the U.S. Court of Appeals for the Federal Circuit. He is also a faculty member of Patent Resources Group (PRG), a leading provider of legal education programs specializing in patent and intellectual property law, and the principal lecturer for PRG’s nationwide Patent Bar Review course.

Berry earned a B.A. and a J.D. from University of Michigan.
