Brooks Kushman Win is Affirmed in Appeal for Infection Prevention Technologies LLC

SOUTHFIELD, Mich. – On Friday, June 20, 2014 the Federal Circuit Court of Appeals upheld a finding that Brooks Kushman`s client, Infection Prevention Technologies LLC (IPT), did not infringe two patents related to ultraviolet sterilization devices held by Lumalier Corp.

This ruling came after an appeal by Lumalier Corp., on the May 2013 decision by the United States District Court for the Eastern District of Michigan confirming that IPT did not infringe on two of Lumalier`s patents.

Brooks Kushman Shareholders Marc Lorelli and Frank Angileri successfully argued that IPT had not infringed on the patents because its device is engineered to measure total radiation, direct and reflected, while Lumalier`s patents cover a method for measuring only reflected radiation.
