SOUTHFIELD, Michigan– Brooks Kushman CEO Sangeeta Shah served as a panelist in a recent IPWatchdog event, the PTAB Masters™ 2021: Winning at the PTAB. This event had sessions that focused on “Beating the PTAB” from the viewpoint of the patent owner. From patent prosecution strategies to harden a portfolio prior to assertion, through PTAB trial and litigation tactics and strategies, this program was designed to prepare patent owners for the challenges of monetizing patents by presenting best practices, expert insights, and master level planning.

The preliminary proceeding of an AIA Trial is perhaps the most critical period for patent owners. With an increased interest in discretionary denials and a rebalancing in the application of patent owner testimonial evidence, the patent owner must act quickly and decisively to halt the proceeding. During this session “Pre-Trial Practice: Finishing it Before it Starts” where Shah was a panelist, leading practitioners presented best practices for patent owner preliminary responses. Topics included: challenging petitions on discretionary matters under 314(a); 325(d); preliminary response evidence; petition preparation; joint defense dynamics; and development of declaration testimony.

Sangeeta Shah is the CEO of Brooks Kushman, responsible for leading the firm’s Executive Committee. In addition to serving as the CEO, Sangeeta maintains an active docket as an IP practitioner with over 20 years of experience in managing patent portfolios, PTAB matters, patent litigation and opinions.  Sangeeta works closely with several Fortune 500 clients for whom she provides strategic counseling and guidance on global intellectual property portfolios.
