ROYAL OAK, Michigan — Brooks Kushman Co-Chair of Post-Grant Proceedings Andrew Turner was recently quoted in a Patently-O article examining the Federal Circuit appeal in Woodway USA, Inc. v. Peloton Interactive, Inc., a case highlighting the interplay between claim construction, PTAB proceedings, and appellate review.

In the article, “Plain, Ordinary, and Unresolved: Woodway’s Two-Front Claim Construction Fight,” author Dennis Crouch explores competing claim construction arguments being advanced before both the U.S. Court of Appeals for the Federal Circuit and the Patent Trial and Appeal Board (PTAB). Turner provided commentary on the evidentiary record and standards of review at issue in the appeal, offering insight into how factual findings and claim scope disputes can shape the outcome of patent litigation and post-grant proceedings.
